The National Audit Office (NAO) has published research on the impact that the UK’s new anti-prostitution legislation is having on organised sex work already working in the UK. The assumption is that because sex work is illegal, vulnerable workers are either forced into work, or must accept criminal sanctions in the form of a prison sentence to avoid it. However, the NAO did not find any evidence that the new legislation is displacing vulnerable workers. The report found that there was a very small increase in domestic workers within the sex trade and in the proportion of sex workers who were serving prison sentences for the most common offence, supplying drugs. The government’s assumption that the Leeds police operation was protecting local women was also challenged, on the grounds that it was actually creating more problems for the M25 sex trade workers by threatening their ability to work. To allow sex workers to sustain themselves, the sex trade had become well established.
In their report, the NAO also cite positive changes in the way the police deal with the realities of sex work, including the fact that a quarter of the police activity was in the domestic sector. However, the report also highlights:
The report found that the new legislation is having a material impact on those who are currently in work, with the incidence of arrest having risen and time spent in prison having increased by a third in the first nine months. The NAO report highlights the important fact that few of those arrested are convicted, as the sexual offence is changed from an indictable to a summary offence. Only about half of those arrested are remanded in custody and only about a third are convicted. There was nowhere for these workers to go.
The report also reveals that, despite it being a summary offence, significantly more people are now being taken to court at the point of arrest in Leeds than elsewhere, which is largely where the operation was focused. d2c66b5586
